In a case highlighting judicial intervention in family matters, the Allahabad High Court has urged a couple embroiled in legal disputes to reunite for the sake of their children.

The bench of Justice Saurabh Srivastava expressed hope that the parents would resolve their differences and lead a stable family life, setting the next hearing for April 28, 2025, to assess the outcome of their reconciliation.

“This court being part of the extended family of advocates as well as litigants, is praying to God that family may unite till the end of their last breath,” Justice Srivastava wrote.

A habeas corpus writ petition was filed on behalf of two minor children, represented by their mother.

In pursuance of the court’s order, the children, their mother, and their father appeared before the court.

During the hearing, after a detailed discussion, the father expressed his willingness to take back his wife and children, a sentiment reciprocated by the mother, who stated her readiness to return to her husband’s residence for the children’s betterment.

Acknowledging the couple’s mutual decision, Justice Srivastava observed that as parents, it was their responsibility to provide a nurturing environment for their children.

“With this hope, it is hereby requested to respondent no.4 and petitioner no.3 that they being parents of corpuses, will lead a proper married life alongwith their children/corpuses and by the time, they shall resolve their dispute for considering the upbringing and better future of their children,” the judge said.

However, the court also noted that the mother had filed criminal cases against her husband and his family.

Given the couple’s agreement to live together peacefully, the high court directed that a copy of its order be placed before the relevant courts handling these criminal proceedings, requesting that they be kept in abeyance until the next hearing.

Before concluding, the court made an emotional appeal, stating that as part of the extended judicial family, it wished for the couple’s reunion to last a lifetime.

The case will be reviewed in April to assess whether the reconciliation effort has succeeded. “Put up this matter on 28.04.2025 as fresh for adjudication of the instant petition on the basis of outcome of reunion of the family,” the court stated.
